Use of Information

Please do not include detailed confidential information about your case when you write to us. Until such time as our attorney has accepted your case or agrees to represent you, you should only include your name, contact information and a brief description of your case, e.g., divorce with custody issues.

There are cases where Zonderlaw.com may ask you for personal information such as your name, address, telephone number, email address, etc. We do this when you complete a Customer Inquiry Form, or other inquiries about other services that require a means for us to confidentially and uniquely identify you. You are knowingly providing this information to us in order to complete a transaction or action on our website. In addition, we may collect and store certain information automatically. This information will not be sold or shared with anyone beyond our website support staff or third party support agencies we use to run our site, except when required by law enforcement investigation, and will be used only as a source of anonymous statistical information. This information may include: (a) Internet Protocol (IP) address of the domain from which You access the Internet, either Your individual address or the proxy provided by Your Internet Service Provider (ISP); (b) Date and time You access our site; (c) Pages You view (recorded by the text and graphics files that compose that page); (d) Web address of the site from which You linked directly to our site; or (e) Browser version and operating system of the computer You are using.

We may use the summary statistics to help us make our site more useful to visitors, such as assessing what information is most frequently searched by visitors, and for other purposes such as determining the site’s technical design specifications and identifying system performance or enhancement areas.

You may choose to provide us with personal information, by sending e-mail with questions or comments or by filling out an online form and submitting it to us through our website. We use this information to (1) gather the requested information; (2) respond to Your message; and (3) follow-up as appropriate. If you choose to correspond further with us through email, we may retain the content of your email messages together with your email address and our responses. We provide the same protections for these electronic communications that we employ in the maintenance of information received by mail and telephone. However, e-mail and on-line forms are not secure against interception and senders have no reasonable expectation of privacy.

Miscellaneous

All disputes between You and Zonder Family Law arising in connection with this Agreement shall be finally settled by binding arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules, using the Expedited Procedures, and judgment on the award rendered by the arbitrator(s) may be entered in any court of competent jurisdiction. The arbitrator shall have no authority to impose penalties or award punitive damages. The arbitration shall take place in La Jolla, California, and the arbitrator shall apply the law of the State of California and applicable rules of evidence. No action, regardless of form, related to the obligations of the parties under this Agreement may be brought by either party against the other more than one (1) year after the cause of action has accrued. In any proceeding to enforce this Agreement, the prevailing party will have the right, in addition to its other rights hereunder, to recover its reasonable litigation costs and reasonable attorneys’ fees. Notwithstanding the foregoing, Zonder Family Law may seek immediate injunctive relief in the event of Your infringement of intellectual property rights hereunder or a breach of Your confidentiality obligations. To the extent that anything in or associated with the Site is in conflict or inconsistent with this Agreement, this Agreement shall take precedence.
